Terms of Service

Please read these Terms carefully. By using 90SecondClinic you agree to be bound by them. Section 9 grants 90SecondClinic broad rights to use submitted videos and athlete likeness for promotional and marketing purposes. Section 17 includes a waiver of class action rights.

1. Acceptance of Terms

By accessing or using 90SecondClinic ("Platform", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all account holders, parents, legal guardians, and coaches ("Talent"). All accounts and submissions on the Platform must be created and operated by an adult age 18 or older. If the athlete depicted in any submitted content is under 18, the account holder must be the athlete's parent or legal guardian, who acts as the submitter on the athlete's behalf. By creating an account or submitting content, you accept these Terms in full, on your own behalf and, where applicable, on behalf of your minor athlete. If you do not agree, do not use the Platform.

2. The Platform

90SecondClinic is a two-sided platform that connects athletes and parents ("Players") with verified professional and collegiate-level athletes and coaches ("Coaches") for video-based mechanics feedback. We facilitate the connection and payment but are not a party to the coaching relationship itself. Coaches are independent contractors, not employees of 90SecondClinic.

3. Accounts and Eligibility

You must be at least 18 years old to create or operate an account on the Platform. Minors may not create their own accounts. If the athlete depicted in submitted content is under 18, the account must be created and operated by the athlete's parent or legal guardian. By creating an account or submitting content on behalf of a minor, you represent and warrant that you are the parent or legal guardian of the athlete and that you have full legal authority to enter into these Terms and grant all licenses and consents described in Section 9 on the athlete's behalf, including, where applicable, on behalf of any other parent or guardian. By creating an account, you represent that all information you provide is accurate, current, and complete and that you will maintain and promptly update your information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to terminate or suspend any account that violates these Terms, that provides false information, or that misrepresents the submitter's age, identity, or relationship to a minor athlete.

4. Clinic Videos

Through the Platform, you may obtain personalized video feedback ("Clinic Videos") from verified Coaches. You may submit a request to a Coach with video of your or your minor athlete's mechanics and a specific question. You acknowledge that the Coach has sole discretion in how to fulfill your request and may not follow your request exactly. Coaches have up to their stated response window to fulfill or decline your request. If a Coach fails to respond within their stated window, you are entitled to a full automatic refund. Clinic Videos are licensed, not sold. Subject to payment in full, the Coach grants the submitter a non-exclusive license to use the Clinic Video for the athlete's personal, non-commercial athletic development.

5. Submission Standards

To receive quality feedback, you agree to submit video content meeting our submission standards: front and side angle views are required, slow-motion footage is strongly recommended, a minimum of three repetitions of the same action, and a specific description of what you want improved. Submissions must be filmed in appropriate conditions with adequate lighting. We reserve the right to request resubmission if videos do not meet minimum quality standards.

6. Coach Verification

Coaches are manually verified by our team using submitted credentials including active roster URLs from official team websites and government-issued identification. Coaches must be at the collegiate level or above. Verification confirms identity and active roster status at the time of verification but does not constitute an endorsement of any Coach's coaching ability or advice. We reserve the right to revoke verification at any time. Coaches agree to maintain accurate credential information and notify us of any changes to their active status.

7. Add-Ons

Coaches may offer optional add-ons to their clinic including Rush Response (guaranteed reply within 24 hours), Extended Response (longer breakdown), Written Notes (timestamped coaching cues), Follow-Up Round (submit again after implementing feedback), and Live Session (upgrade to a video call). Add-ons are subject to platform minimums and coach-set pricing. Add-ons are non-refundable once a Coach has begun work on the response.

8. Fees and Payment

All payments are processed securely through Stripe. The Platform retains a 20% fee on each transaction. Coaches receive 80% of all amounts paid, paid out within 2 business days of completing a response via Stripe Connect. All prices are in USD. Players are entitled to a full automatic refund if a Coach fails to respond within their stated response window. Refunds may take 5 to 10 business days to appear on your statement. All sales are final once a Coach has submitted their response. We do not offer refunds based on dissatisfaction with feedback content. Minimum clinic price is $25.

9. Video Content, Likeness, and Consent

By submitting any video, image, audio, or other content to the Platform, you grant the rights described in this Section. The act of submission constitutes your knowing and voluntary consent to all uses described below. These uses cover both the video content you submit and the resulting Coach response video. Representations. You represent and warrant that: (a) you are at least 18 years old; (b) you are the athlete depicted in the submitted content, or you are the parent or legal guardian of the athlete depicted and have full legal authority to grant the licenses below on the athlete's behalf; (c) any other parent or legal guardian of the athlete consents to these uses; (d) no third party has a conflicting claim to the athlete's image, likeness, voice, or the submitted footage; and (e) you have obtained any other consents required for the content depicted. Submitter License. You grant 90SecondClinic and its successors, assigns, and authorized partners a non-exclusive, royalty-free, worldwide, perpetual, sublicensable, irrevocable (subject to the opt-out below) license to host, store, copy, edit, excerpt, modify, create derivative works from, publicly display, publicly perform, distribute, transmit, stream, and otherwise use the submitted content, the resulting Coach response video ("Response Video"), and the athlete's name (first name only on public surfaces), image, likeness, and voice, in any and all media now known or later developed, for any platform, promotional, marketing, advertising, editorial, or commercial purpose. Authorized uses include but are not limited to: display of the submitted video and the Response Video on the Platform; display on the responding Coach's public profile; display in homepage feeds, before-and-after comparison features, and other promotional surfaces of the Platform; posts on social media accounts operated by 90SecondClinic or its partners; paid advertising and sponsored content; press releases, partner co-marketing, case studies, and pitch materials. Coach License. Coach response videos remain the intellectual property of the responding Coach. The Coach grants 90SecondClinic the same comprehensive license described above with respect to Response Videos. The Coach also grants the submitter a non-exclusive license to use the Response Video for the athlete's personal, non-commercial athletic development. No Compensation. You acknowledge and agree that no compensation, royalty, or other payment will be owed to you, the athlete, or any third party for any use authorized under this Section, beyond any clinic fee paid for the response itself. What Stays Private. The written submission details that accompany your video, including the specific question, additional context, age, height, weight, and similar fields, are not displayed publicly and are visible only to you, the Coach, and Platform staff. Public surfaces never include the athlete's full name, the written submission details, or other personally identifying information beyond the athlete's first name. Opt-Out. You may opt out of public and promotional display for any clinic at any time from the submission detail page. Once you opt out, 90SecondClinic will remove the submitted video and the Response Video from surfaces it directly operates within a reasonable period and will use commercially reasonable efforts to discontinue further use of the videos in active promotional materials. You acknowledge that materials already published, distributed, or shared, including content reshared by third parties, embedded by users, included in archived posts, or already aired in paid placements, may not be fully recoverable, and 90SecondClinic has no obligation to recall, retract, or destroy such materials. The licenses granted in this Section survive opt-out as to all materials already created, published, or distributed prior to opt-out. Restrictions on You. You may not redistribute, sell, modify, or publicly broadcast Response Videos beyond your personal, non-commercial use without express written consent from 90SecondClinic and the Coach. You must not submit content that depicts a minor in an inappropriate context, that is illegal or obscene, that violates the privacy or rights of any third party, or that you are not legally authorized to share. Survival. The licenses, releases, and waivers granted in this Section survive termination of your account and termination of these Terms.

10. Coach Conduct and Strikes

Coaches agree to respond within their stated response window, provide honest and professional feedback, and maintain accurate credential information. Coaches who miss their response window will receive a strike and may be temporarily or permanently delisted from the Platform. First offense results in temporary delisting until the Coach confirms their availability. Repeat offenses may result in permanent removal. Coaches who are delisted forfeit any pending payouts for submissions they failed to respond to.

11. Prohibited Conduct

You may not use the Platform to: harass, threaten, or impersonate any person; submit false or misleading information including false credentials; misrepresent your age, your identity, or your relationship to or authority over a minor athlete depicted in submitted content; submit content depicting a minor without the authorization of that minor's parent or legal guardian; attempt to circumvent payments by transacting off-platform; contact players or coaches outside of the Platform for commercial purposes related to the coaching relationship; scrape or copy Platform content; submit content that is illegal, obscene, harmful, or violates the rights of others; use the Platform for any unlawful purpose; or create accounts under false identities.

12. Minors, Parents, and COPPA

The Platform is built for adult account holders submitting on behalf of themselves or on behalf of a minor athlete. Account holders must be at least 18 years old. Athletes under 18 may not create or operate their own accounts on the Platform. A parent or legal guardian may create an account and submit videos on behalf of a minor athlete; in doing so, the parent or guardian acts as the submitter, accepts these Terms on the athlete's behalf, and grants the licenses and consents described in Section 9. We do not knowingly collect personal information directly from children under 13 in violation of the Children's Online Privacy Protection Act ("COPPA"). Information about a minor athlete that appears on the Platform is provided to us by the submitting parent or legal guardian, not collected from the child directly. If you believe an account has been created or content has been submitted in violation of these requirements, contact us at support@90secondclinic.com and we will promptly investigate and, where appropriate, delete the account and information.

13. Coach Referral Program

Verified coaches in good standing may participate in the 90SecondClinic Referral Program. By sharing your unique referral link, you may earn a referral bonus equal to 3.75% of the gross transaction value of each paid clinic completed by a coach you successfully refer to the Platform ("Referred Coach"). Eligibility. To earn referral bonuses, you must: (a) be a verified coach with an active account in good standing on the Platform; and (b) have completed at least one paid clinic response in the 12 calendar months preceding each monthly payout. If you fail to meet the activity requirement in any month, your referral bonuses for that month will be forfeited and your referral relationships may be marked inactive. Successful Referral. A referral is deemed successful when a coach you referred signs up using your unique referral link, completes the Platform's verification process, and is approved as a verified coach. Payout. Referral bonuses accrue automatically for each qualifying clinic completed by your Referred Coaches and are paid in a single batch transfer to your Stripe Connect account on or around the 1st of each calendar month. Minimum transfer thresholds may apply per Stripe's policies. We reserve the right to withhold payment if we suspect fraudulent activity. No Cap. There is no limit on the number of coaches you may refer or the total referral bonuses you may earn, subject to the eligibility requirements above. Program Changes. 90SecondClinic reserves the right to modify, suspend, or terminate the Referral Program at any time with 30 days' notice to active participants. Changes will not affect bonuses already accrued prior to the effective date of any change. Taxes. You are solely responsible for any taxes owed on referral bonus payments. 90SecondClinic will issue applicable tax forms as required by law.

14. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. We do not warrant that coaching feedback will improve athletic performance. All feedback is the opinion of the individual Coach and should be evaluated alongside guidance from qualified in-person coaches and medical professionals. We make no representations about the accuracy or completeness of any coaching feedback.

15. Limitation of Liability

To the maximum extent permitted by law, 90SecondClinic shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid for the transaction giving rise to the claim in the 12 months preceding the claim.

16. Indemnification

You agree to indemnify, defend, and hold harmless 90SecondClinic and its officers, directors, employees, agents, successors, and assigns from and against any and all claims, costs, proceedings, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to: your use of the Platform; your violation of these Terms; your submission of any content; any claim that you misrepresented your age, your identity, or your relationship to or authority over a minor athlete depicted in submitted content; any claim that the licenses, consents, or releases granted in Section 9 were not validly authorized; any claim by an athlete, an athlete's other parent or legal guardian, or any third party concerning the use of the athlete's image, likeness, voice, or name on or in connection with the Platform; or any breach of your representations and warranties in these Terms.

17. Waiver of Class Actions

You and 90SecondClinic each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class or representative action. You waive your right to participate as a plaintiff or class member in any class action lawsuit against 90SecondClinic.

18. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in California.

19. Changes to Terms

We may update these Terms at any time. We will notify registered users of material changes by email and by updating the "Last Updated" date above. Continued use of the Platform after changes constitutes acceptance of the new Terms.
